| 06/16/2003 | On June 11, 2003 the Munich District Court I (Landgericht) decided in favor of Shimano regarding Shimano's patent infringement law suit against SRAM Deutschland GmbH, its director, Mr. Kai-Uwe Rüde, and SRAM Corporation Europe Livisham Limited.
The complaint served to protect Shimano's interest and rights in Shimano's European Patent 0 313 345, which is known as HYPER GLIDE-technology.
Following the decision of today (docket Nr. 21 O 21210/00), SRAM Deutschland GmbH and the other defendants in this case will no longer be allowed to market its "Powerglide II" brand cassettes (sold under their 5.0 and 7.0 trademarks) in Germany, even if SRAM exercises its right to appeal the decision because Shimano intends to secure a deposit to enforce its patent rights.
A Shimano spokesman said that everybody in the company was extremely glad about this decision, especially from the background of the efforts it took to gain market acceptance for the Freehub/Cassette-System and the Hyperglide/Index-system by the time of introduction.
Shimano has the right to enforce this decision against the defendants after posting a required security deposit, even if the defendants choose to file an appeal. In view of this, Shimano advises all customers that it intends to enforce this decision against the defendants in order to protect Shimano’s legal rights.www.shimano-europe.com
